Functions of the Municipality of Elbasan:

Articles 23-29 of Law no. 139/2015, "ON LOCAL SELF-GOVERNMENT"

 

 
Article 23
Functions of Municipalities in the Field of Infrastructure and Public Services

 
In the field of infrastructure and public services, municipalities are responsible in their jurisdiction for:
1.      Production, treatment, transmission and supply of drinking water.
2.      Collecting, removing, and treating contaminated waters.
3.      Collection and removal of rainwater and flood protection in residential areas.
4.      Construction, rehabilitation, and maintenance of local roads and road signs, sidewalks and local public squares.
5.      Lighting of public areas
6.      Local public transport.
7.      Construction, rehabilitation, and maintenance of public cemeteries, as well as the guarantee of public burial service.
8.      Public décor service.
9.      Parks, gardens, and public green spaces.
10.  Collection, removal, and treatment of solid and household waste.
11.  Construction, rehabilitation, and maintenance of educational buildings of the pre-university education system, with the exception of vocational schools.
12.  Administering and regulating the pre-school education system in kindergartens.
13.  Construction, rehabilitation, and maintenance of primary health care facilities and development of educational and promotional activities at the local level related to health protection, as well as administration of centers and other services in the field of public health, as defined by law.
14.  Planning, administration, development and control of the territory as prescribed by law.

 
Article 24
Municipal Functions in the Field of Social Services

Municipalities are responsible for carrying out these functions:
1.      Creation and administration of social services at the local level for people in need, people with disabilities, children, women, women head of household, battered women, traffic victims, mothers or parents with many children, as prescribed by law.
2.      Construction and administration of housing for social housing, as prescribed by law.
3.      Construction and administration of centers for provision of local social services.
4.      Creation, in cooperation with the ministry responsible for social welfare, of the social fund for the financing of services, as prescribed by law.

Article 25
Functions of Municipalities in the fields of Culture, Sports, and Entertainment Services
 

Municipalities are responsible for carrying out these functions:
1.      Development, protection, and promotion of cultural values and cultural heritage of local interest, as well as the administration of facilities related to the exercise of these functions.
2.      Organization of cultural activities and promotion of national and local identity, as well as the administration of facilities related to the exercise of these functions.
3.      Development, protection, and promotion of libraries and reading facilities for the purpose of general education of citizens.
4.      Organization of recreational, recreational and entertainment activities, development and administration of institutions, and facilities related to the exercise of these functions.

Article 26
Municipal Functions in the Field of Environmental Protection

Municipalities are responsible for carrying out these functions:
1.      Ensure, at the local level, measures for the protection of air, soil, and water from pollution.
2.      Ensure, at the local level, measures for the protection against acoustic pollution.
3.      Development of educational and promotional activities at the local level, which are related to environmental protection.

Article 27
The Functions of the Municipalities in the Fields of Agriculture, Rural Development, Public Forests and Pastures, Nature and Biodiversity

 
Municipalities are responsible for carrying out these functions:
1.      Administration, use, and maintenance of irrigation and drainage infrastructure, transferred to their ownership, as prescribed by law.
2.      Administration and protection of agricultural lands and other categories of resources, such as unfruitful land, etc., as prescribed by law.
3.      Creation and administration of the local information and agricultural and rural information system, according to the legislation in force.
4.      Creation and administration of local schemes of rural development and rural development grants, financed by the local budget and / or co-financing from third parties, ensuring balanced gender access.
5.      Administration of public forest and pasture fund, according to the legislation in force.
6.      Protection of nature and biodiversity, according to the legislation in force.

Article 28
Municipal Functions in the Field of Local Economic Development

 
Municipalities are responsible for carrying out these functions:
1.      Develop strategic development plans and programs for local economic development.
2.      Establishment and functioning of public markets and trade networks.
3.      Support for small business development, through incentive activities, such as fairs and advertising in public places.
4.      Organization of services in support of local economic development, such as business information, promotional activities, making public assets available.
5.      Publication of informative brochures, creation of economic profile portals, etc.
6.      Granting financial grants to support small and medium business activities, in the manner set out in the legislation in force, ensuring balanced gender access.

Article 29
Municipal Functions in the Field of Public Safety

 
Municipalities are responsible for guaranteeing these functions:​
1.      Civil protection, at the local level, and administration of the relevant structures as prescribed by law.
2.      Guaranteeing the fire service at the local level, and administering the relevant structures, as prescribed by law.
3.      Ensuring the maintenance of community relations, prevention, and mediation in resolving conflicts in the community.
4.      Preventing administrative offenses, strengthening, inspecting and monitoring the implementation of regulations and acts of units of local self-government within their local jurisdiction and in compliance with legal definitions.
